Statewide Weekly Wages for 2019

Philadelphia Workers’ Compensation Attorneys provide information on Statewide Weekly Wages for 2019 released by the Pennsylvania Department of Labor and Industry. Each year, the Pennsylvania Department of Labor and Industry (DOL) releases the Statewide Average Weekly Wage. This number is used to calculate the maximum amount of workers’ compensation wage loss benefits that injured workers may receive under the Pennsylvania Workers’ Compensation Act (“the Act”).

Pennsylvania Workers’ Compensation

Workers’ compensation laws vary from state to state; therefore, workers should seek legal advice from a qualified attorney in their area. In Pennsylvania, most employees may receive workers’ compensation for their work-related injuries. Workers must notify their employers of their injuries within 120 days to remain eligible. The system is no-fault; therefore, employees may collect benefits without having to prove that their employer either negligently or intentionally caused their injuries.

Pennsylvania workers’ compensation benefits include reasonable and necessary medical expenses, wage loss, vocational rehabilitation, specific loss, and death benefits. Workers who miss more than seven days of work due to their injuries may receive wage loss benefits for either partial or total disability. Those who qualify for total disability may receive two-thirds of their average weekly wage, and those who qualify for partial disability may receive two-thirds of the difference between their pre- and post-injury wages, up to an annual cap set by the Pennsylvania DOL.

Maximum Workers’ Compensation Available in Pennsylvania

Workers receiving wage loss benefits may collect two-thirds of their wages up to the capped amount that is set annually by the Pennsylvania DOL. For calendar year 2019, the maximum weekly compensation rate is $1,049. Therefore, workers with average weekly wages higher than the statewide average will only be able to collect a maximum of $1,049. Employees who are receiving total disability wage loss benefits for injuries that occurred on and after January 1, 2019 are eligible to receive two-thirds of their average weekly wage up to a maximum of $1,049.

Under the Act, the maximum weekly compensation payable is 66 and two-thirds per centum of the statewide average weekly wage if the employee’s average weekly wage was between $1,573.50 and $786.76. Employees who have an average weekly wage that falls between $786.75 and $582.78 will receive $524.50. Those whose average weekly wage is $582.77 or less may receive 90 percent of their average weekly wage.

Slight Increase in Maximum Compensation Since Last Year

The maximum weekly compensation rate for 2018 was $1,025. That year, employees whose average weekly wages totaled between $1,537.50 and $768.76 were eligible for the 66 and two-thirds compensation rate. Those whose fell between $768.75 and $569.44 received $512.50, and those who earned $569.43 or less received 90 percent of their average weekly wages.

Payments for medical treatment rendered on and after January 1, 2019 must be updated to reflect the new rates. According to the Pennsylvania DOL, the percentage increase in the Statewide Weekly Wage is 2.3 percent.
